FOUNDING WAITLIST PRIVACY NOTICE

This Founding Waitlist Privacy Notice explains how Modern Day Sports LLC, a North Carolina limited liability company (the "Operator"), collects, uses, and protects information from people who join the free Founding Waitlist for Modern Day Sports Institute ("MDSI") through the Operator's online application (the "App").

INFORMATION WE COLLECT
1. FROM YOU (THE PARENT, GUARDIAN, OR ADULT JOINING): name, email address, and phone number.
2. ABOUT ATHLETES (OPTIONAL): an athlete's first name and age, only if you choose to provide them and only if you are that athlete's parent or legal guardian. Do not enter last names, birthdates, photos, school, or medical information.
3. CONSENT RECORDS: your checkbox choices (waitlist terms and the optional VIP email opt-in), the date and time, your IP address, and the version of the Terms you accepted, so we can show what you agreed to.
4. BASIC TECHNICAL DATA: log data and any cookies needed for the App to work (no analytics tools are used at this time).

WHAT WE DO NOT COLLECT
We do not collect any payment information. No card number, card authorization, bank information, Stripe data, deposit, or fee is collected or processed for the Founding Waitlist.

HOW WE USE INFORMATION
To keep the Founding Waitlist; send your confirmation, changes to the Terms, and the Opening Notice and founding rate offer; send VIP build updates only if you opted in; understand interest by age group for planning; and protect the App from misuse.

HOW WE DISCLOSE INFORMATION
We do not sell personal information, and we do not disclose it for others' advertising. We disclose information only (1) to service providers who help us run the App and send email, such as Vercel (hosting), Neon (database), and Resend (email), who may use it only to provide services to us; (2) when required by law or to protect safety; (3) to a successor that takes over operation of MDSI and agrees to honor this Notice; and (4) in aggregate form only (for example, the total number of waitlist members or interest by age group), which does not identify you or any athlete, to our lender, landlord, or professional advisers.

TEXT MESSAGES
We will not text you unless you separately agree.

CHILDREN'S PRIVACY (COPPA)
The App and the Founding Waitlist are for adults 18 and older. We do not knowingly collect personal information directly from children under 13. Only a parent or legal guardian may provide an athlete's first name and age. If we learn that a child under 13 has given us personal information directly, we will delete it. Contact info@modern-day-sports.com if you believe this has happened.

PARENT AND GUARDIAN RIGHTS FOR MINORS' INFORMATION
A parent or legal guardian may review, correct, or delete the athlete information they provided, or stop further collection, at any time in the App or by emailing info@modern-day-sports.com. We will respond within 30 days.

RETENTION
We keep waitlist information while you are on the Founding Waitlist and until the waitlist closes or 24 months after opening, whichever is sooner, or sooner if you leave, then delete it. If you leave the waitlist, we delete your information within 30 days of your request, except that we keep your email address on a do-not-email list if you unsubscribed, so we can honor your choice.

SECURITY
We use reasonable safeguards, including encrypted connections (HTTPS) and access limited to staff who need it. No system is perfectly safe. If a breach affects your personal information, we will notify you as required by North Carolina law.

YOUR CHOICES
Unsubscribe from VIP updates with the link in any VIP email. Leave the Founding Waitlist anytime with the "Leave Waitlist" link, in the App, or by email.

CHANGES TO THIS NOTICE
If we make material changes, we will email you and post the updated Notice in the App before the change takes effect.
